Agreement

This is a binding legal agreement between you, the user sometimes called "user" or "you" of the Programs, as defined below and Schola Classes (and its subsidiaries and affiliates around the world, collectively "Schola," "us," "we" or "our"), which outlines the terms and conditions on which you are allowed to access and use the Platform, defined below. The website www.scholaclasses.com and mobile applications collectively referred to herein as the "Platform" and the information, services, and other materials contained therein, is provided and operated by Schola Classes. Schola offers curated and specially designed online and offline education and career assistance services ("Programs").

Review our Terms of Use, Privacy Policy, and other policies available on the Platform (collectively referred to as the "Terms") that govern the use of the Platform and Programs. By accepting these Terms in any manner or accessing the Platform, you consent, agree, and undertake to abide by and adhere to the Terms. In case you do not agree to accept these Terms, you are not eligible to enjoy or use the Programs, and further use shall be unauthorized.

Each Program may have its own terms with respect to refund, deferment of payment, etc., relating to such Programs. Corporate clients may have had separate agreements in writing with us and in cases of conflict will prevail over these Terms, in respect of the extent of conflicting provisions.

These Terms shall apply to Schola-hosted mobile apps, WhatsApp groups, Facebook groups, Instagram pages, Facebook pages, email/SMS/ phone communications and other social media forums hosted by Schola which shall be deemed, by reference to form part of the 'Platform'. You acknowledge that various parts of the Platform, as described above, are offered by third-party service providers and agree to comply with their terms and conditions. Schola shall not be responsible for any loss or damage caused by third-party service providers or by the failure of third-party service providers to exercise their services via the Platform.

You may "bookmark" a particular portion of the Platform and thereby bypass these Terms, your use of the Platform still binds you to these Terms.

We may update these Terms from time to time without notice to you. You should check this page regularly. Your use of the Platform and Programs after changes are posted will constitute acceptance of those changes. If you are not satisfied with any changes, you should not continue to use the Platform or Programs.

Schola makes no representation that the Platform operates (or is legally permitted to operate) in all geographic areas, or that the Platform or the information, services, or products offered through the Platform are appropriate or available for use in other locations. Users access the Platform at their own risk and are responsible for compliance with local laws. You agree and acknowledge that if you decide to access the Platform, that doing so is your own initiative and at your own risk and that you shall be responsible for ensuring compliance with all applicable laws.

User Accounts, Registration, and Delivery of Services

Account Creation

You need to register a User Account by completing a two-step verification process of your login, whereby you will be required to verify your phone number with a one-time password that will be delivered to your cellular phone; or provide an email address and a unique password so that you can perform most of the activities on the Platform or to apply for a Program.

Access to Programs

Upon receipt of Program fees which you may pay partially or wholly at your discretion depending on the Program, Schola will issue to you the Terms of Use of the Program, and grant access to the Program. An invoice shall be deemed delivered to you together with your acknowledgement by email, and it shall be considered as delivered two months after delivery but for the safe payment of the Program fees.

In exceptional circumstances, if Schola has granted you access to a Programme pending payment, and Schola are not received by us within agreed time frames, Schola may at our discretion withdraw your access to the Programme without prior notice.

Account Security

You agree that you shall never disclose or share access to your User Account with a third party for any reason. You also agree that you shall create, use, and access only one User Account and shall not use a User Account other than your own.

Account Information

Once you create your User Account, you will be prompted to provide more information which, without limiting the generality of the foregoing, includes but is not limited to your name and email address. Depending on the requirement, you may have to provide additional information in order to verify your identity. You agree that all the information that you provide to us is accurate, current and complete and that you will update and keep your information current, accurate and complete. You agree that, if any of the information you have provided is untrue, inaccurate, not current or incomplete, we may terminate your use of the Platform and your enrollment in a Program, where applicable.

Personal Data

In addition to the registration process, as you access and use the Platform or engage in the Programs, we may collect certain information relating to you and your activities under the Programs. Some of this information is Personal Data. We may use, maintain and store such information in order to provide certain services to you now and in the future, and may share such information with our Educational Partners or third parties in conjunction with such services or for the purpose of marketing. For example, as explained further in our Privacy Policy, we may provide some materials or information about you to third parties, such as your grades or scores in our classes. Regardless of whether you have registered yourself under DND, DNC, or NCPR service, you agree that we can call you from us or any third party for the purposes mentioned above within 365 days from the date you have registered with us.

Access to the Programs is reserved for registered participants or students whom Schola has specifically authorized.

By registering a User Account, you agree that:

  • You are registered for a Program only one time and will not create more than one User Account.
  • You will comply with these Terms and other terms specific to a Program.
  • Other conditions applying to students. Students, apart from the above, accept that by registering, they intend to carry out the assignments, if applicable and relevant, that pertain to the Platform or Programs in which they have enrolled.

Payment Terms and Refund Policy

Payment Methods

Except otherwise agreed in writing by Schola, full participation fee for any Program shall be paid on registration. Where applicable, a Program can include a trial window that only becomes available after full payment. During the trial period, if a student so requests and is acceptable to Schola, Schola may, subject to such refund policy applicable to the Program concerned, exercise the option of refunding the fees paid for that Program, with applicable deductions of charges like administrative and marketing costs, etc., based on decisions taken by Schola from time to time. Refunds will not be allowed for any reason after the trial window is closed. For all Programs where there is no trial window or preparatory session, refunds shall be made in terms and conditions of the refund policy of the concerned Program.

It is the sole responsibility of the user enrolling into a Program to check the accuracy of and evaluate the suitability and relevance of the Program elected. The enrollment into a Program is not transferable.

To pay for any Program or to buy any services or products offered by Schola through the Platform, you will need to have access to the Internet and a current valid accepted payment method, as indicated during sign-up ("Payment Method"). Schola does not store any of your credit card information or any other information that is restricted by the Reserve Bank of India (RBI) for processing payment and has collaborated with payment gateways for the payment towards the services. Using a third-party payment provider renders you liable to agree to abide by the terms of such a payment provider. You agree that, if the third-party payment provider of Schola stores any of such information, Schola shall have no responsibility for such storage, and it shall be entirely up to you to permit the third party to store such information. In the event that any information of this nature or any loss resulting from your use of it is lost, Schola will not bear any responsibility or liability and shall not be liable to compensate or make restitution in any manner whatsoever for any loss suffered by you. You agree to pay any applicable fees charged for the payments processed through the Platform.

Neither Schola nor its agents will request the OTP or any authentication-related information for any reason, and we urge you to exercise caution in any transactions involving payment or financial matters.

If you do not pay the applicable Program fee, we may withdraw your access to a Program. Depending on where you complete the transaction with us, the type of payment method you are using, and where your payment was issued, your transaction with us might incur foreign exchange fees or exchange rates. Schola does not accept all payment methods, currencies, or locations for a payment. All applicable taxes are computed based on the billing information you supply to us at the time of enrollment or purchase.

Refund Policy

We are dedicated to having you satisfied with any item, service, course, or workshop that you have purchased from us. Please read the following terms carefully, as they govern our refund policy.

Workshops:

No Refunds/Credits: There are no refunds or credits given for workshops.

Courses:

We do not give refunds of course: It should be deeply considered what your schedule and dedication would look like prior to enrolling.

Transfer Policy: You can transfer your enrollment into the next cohort. A minimal administrative fee will be charged for such transfers.

Exceptional Circumstances: If a refund is processed due to some exceptional circumstances, note that the transaction would take about 5-7 business days to get processed by our payment partners (Razorpay and Stripe, among others). Amount will be credited back to the original method of payment.

Cancellation Policy

A Program cancellation shall be governed by the refund policy as outlined above. Each program shall have specific refund conditions which would apply in the event of a cancellation and resulting in the applicable refund for such request.

If you have subscribed for a free trial, the free trial period will last for the period of time specified during your sign-up. Free trials may not be combined with certain other offers. If you have subscribed to a particular paid service or product within the last six months or if your Payment Method, physical address, contact number, or email address has been used on an account for that paid service, you do not qualify to start a free trial for that service or product. If you buy a free-trial subscription, you'll probably find you don't have access to all the features of a program during that free-trial subscription period.

Program Management

Schola has the right to cancel or postpone any of its Programs or lectures/webinars live and to change, modify, or reorganize the topics schedule as well as the assignments, tests, quizzes, exams, projects, and other such measures for assessing progress.

Use of the Website: By using the Website, you acknowledge and agree that Schola, at its discretion, may limit, suspend, or terminate your use of the Platform or Programs and/or all Schola-provided services related to the Programs, including any access to coaches or support services, evaluation services, or certifications. You understand that Schola also may change or discontinue all services related to its Programs at its discretion. You understand and agree that Schola shall not be responsible or liable to you or any third party for any such modification, suspension, or discontinuance. These Terms shall not create any obligation on the part of Schola to maintain and support the Platform or Programs or any part or portion thereof or any associated services.

You shall hold Schola harmless against any claim whatsoever relating to the non-availability of the Platform or any part thereof arising from causes beyond Schola's control including, without limitation, acts of God, war, disease, revolution, epidemic, riot, civil commotion, strike, lockout, flood, fire, satellite failure, failure of any public utility, man-made disaster, or any other cause whatsoever.

Subject to any applicable refund policy, you may terminate your participation in any Program at any time by providing prior notice to Schola. Participants of Schola's online live lectures and webinars will receive access to such classes through an email or through the Platform. You agree not to share that access with any third party. In case you are unable to attend an online live lecture or webinar, kindly ensure to provide Schola with prior intimation regarding this.

You shall be solely responsible for obtaining and maintaining any equipment or ancillary services needed to connect to, access, receive, or use the Platform, including, without limitation, hardware devices, software, and other internet, wireless, broadband, phone, and/or other mobile communication device connection services. You are responsible for ensuring that any such equipment or ancillary services will work with the Platform, and you are responsible for all costs related to your use of the Platform and Programs in conjunction with all such equipment and ancillary services.

Educational Partners and Accreditation

Schola is NOT a university but an education service provider, providing Programs in consultation with Indian and international universities, educational institutions, governmental authorities, NGOs, corporates, etc. (each, hereinafter referred to as "Educational Partner").

Access to any Educational Partner degree/diploma programs is not dependent upon admission into or participation with one or more Programs. You acknowledge and agree that nothing in these Terms or otherwise with respect to using the Platform or any Program:

  • (a) access to or use of the resources or receipt of any benefit or privilege of any Educational Partner other than the Programs.

Schola may issue a credential or other form of recognition for participants who satisfactorily demonstrate their mastery of Program material. The decision whether to award any such credential or recognition to a particular participant shall be within Schola's sole discretion. Schola may decline to grant any credential or other form of recognition in respect of some Programs. Schola is entitled in its absolute discretion to determine whether to provide a record relating to participant performance in a Program. Any form of recognition and credential, and any record of performance, to be provided by Schola relating to Programs shall be determined in its absolute discretion by Schola and may vary from time to time and Program to Program.

You will obtain only a certificate of successful completion of a Program (Program Certificate) if and when you have met the requirements and conditions of Schola and its Educational Partners.

If you enroll for academic credit or certification as a student of, or otherwise through, an Educational Partner, any such credit or certification may only be granted directly by the Educational Partner in accordance with its own policies and procedures. You may be required by that Educational Partner to be registered or enrolled with the Educational Partner in order to earn credit or certification. In any event, Schola shall have no authority or responsibility regarding any academic credit or certification award from an Educational Partner for a Program.

You acknowledge and agree that any Program affiliated with an Educational Partner is subject to the terms, policies, and procedures of the applicable Educational Partner in addition to Schola's Terms. Without limitation of the foregoing, if you are a student registered or enrolled at, or otherwise attending, an Educational Partner and are taking a Program for credit or certification through that Educational Partner, you acknowledge and agree that:

  • (a) The Educational Partner may have their own terms, policies, or procedures regarding your eligibility to enroll in the Program, your participation in the Program, requirements or prerequisites to earn credit or certification in connection with the Program, and/or educational or student records as they may apply to your participation and performance in the Program.
  • (b) The Learning Affiliate retains records of your educational or student records for the purpose of assigning credit or certification, and Schola doesn't.
